Time to Review your Will if you own EU property

The EU Succession Regulation came into force in August 2015. If you are an Irish resident who owns property in other EU jurisdictions, you should review your Will both in Ireland and the country where the property is situated.

The Regulation determines which law applies to the administration of your Estate on death but as Ireland has opted out of the Regulation, it has yet to be seen how this will be interpreted in relation to the Estates of Irish residents. Therefore to ensure that your Estate situated here and abroad passes to your chosen beneficiaries in the most tax-efficient way and to minimise the risks of disputes, we recommend that a Choice of Law clause be inserted in your Will.
